Runway Visitor Park aircraft tour terms and conditions

Introduction

The terms and conditions set out below (the “T&Cs”) apply to all Runway Visitor Park (“RVP”) aircraft tour bookings (“Tours”) made on this website. By booking or attending a Tour you acknowledge that you have read, understood, and will be bound by these T&Cs.

The RVP is operated by Manchester Airport Plc (“MAN”), a subsidiary within the Manchester Airports Group of companies (“MAG”).

Throughout these T&Cs all references to ‘us’, ‘our’ or ‘we’ will be references to MAN and all references to ‘you’ or ‘your’ will be references to the person booking the Tour unless stated otherwise.

Definitions

Adult” means persons aged 18 and over;

Child” means persons aged 16 and under, and “children” shall be construed accordingly;

Data Protection Legislation” means any law, statute, declaration, decree, directive, legislative enactment, order, ordinance, regulation, rule or other binding restriction as updated and amended from time to time which relates to the protection of individuals with regards to the processing of personal data to which a party is subject, including the Data Protection Act 2018 (“DPA”) and the retained EU law version of the GDPR, and/or any corresponding or equivalent UK laws or regulations and any replacement, amendment, re-enactment or consolidation of the same from time to time together with all subordinate legislation;

Educational Tour” means a Tour as detailed on the Educate section of the Website, for school groups from early years to KS4, as well as out of school groups;

Nimrod Tour” means the Nimrod Classic Tour or the NIMROD SHORT or the Nimrod & Concorde Technical Tour as detailed on the Website;

Presentations” means the materials presented to you on the Tour, including any audio guide;

RVP” means the Runway Visitor Park at Sunbank Lane, Altrincham, WA15 8XQ;

RVP Staff” means any of our staff, employees or representatives;

Special Assistance Dog” means a dog that is specifically trained to assist you or an attendee with a disability;

T&Cs” mean these terms and conditions, as updated by us from time to time;

Website” means the RVP website which can be found at: Homepage | Runway Visitor Park.

Booking Conditions

Tours can be booked by persons aged 18 years or over. Proof of age may be requested by us at any time.

Children must be always accompanied by an Adult. The accompanying Adult shall be responsible for the Child’s actions, conduct and compliance with these T&Cs.

Please note there is a height restriction for any Nimrod Tour. You and all attendees must be 1.2 meters or taller to participate in a Nimrod Tour. Please check the specific details of the tour you wish to attend on the Website, as other restrictions may apply depending on the specific tour booked.

Tour bookings must be made no later than 8am on the date the Tour is due to take place.

Tours are subject to availability, and we reserve the right to withdraw availability of the RVP at our entire discretion.

When you have completed your booking, we will send you written confirmation of your booking by email to the address entered by you. You are responsible for supplying a valid email address. We do not accept liability for non-delivery due to transmission failure. In the event of any problems or to amend your booking, please phone 0161 489 3932*

*Calls are charged at 10 pence per minute from a BT landline. Calls from mobiles and other networks may vary.

Each booking is valid for a single Tour. The Tour will be of the aircraft you selected at the time of booking, for the date and time booked.

Except for Special Assistance Dogs, dogs are not permitted at the RVP and cannot be left in your vehicle. Entrance to the RVP will be refused if you or anyone in your party arrives with a dog.

You must not resell or transfer any Tour booking (in whole or in part).

If purchasing a gift voucher for a Tour, this will be valid for 12 months from date of purchase.

Educational Tours

If you are booking or attending an Educational Tour, this section of the T&Cs will also apply:

Please remember that teachers must remain in control of the children at all times. There must be at least one (1) Adult attending per ten (10) children.

Coach, minibus and car parking for Educational Tours is free at the RVP. Parking spaces will be allocated to you on arrival. If your transport leaves the park for operational reasons, it is YOUR responsibility to arrange a collection time with the driver for your return journey.

Entry to the RVP

The visit will operate between the agreed times of the Tour booking only. If for any reason you are delayed, please contact us immediately on 0161 489 3932. For operational reasons, we may have to deduct the time lost from your visit.

You must show your confirmation email to RVP Staff on arrival.

Your entry to the RVP is entirely at our discretion. We reserve the right to refuse your entry or require you to leave the premises at any time.

In the event that you are denied entry or asked to leave the premises, we reserve the right to exclude you from booking a Tour or attempting to attend the RVP in future.

You will be permitted to make visual recordings of the Tour, subject to the following limitations:

a) the Tour is not filmed in its entirety;

b) the recording / photography does not capture any RVP Staff without their consent;

c) the use of recording equipment is at our sole discretion;

d) any recordings made are for private and personal use only; and

e) our presentations are protected by personal copyright. Accordingly, you are not permitted to make any audio or visual recordings or images of the Presentations unless specific permission has been given in writing.

We do not permit smoking, eating or drinking within any of the buildings or aircraft exhibits at the RVP.

Facilities

Refreshments are not included in your Tour. Refreshments can be purchased at the restaurant on site.

Toilet facilities are available at the RVP.

Amendments and Cancellations

You may request to change the Tour to an alternative date/time provided you make this request at least fourteen (14) days prior to your Tour date.

You have the right to cancel a Tour booking where payment has been made, but you shall not be entitled to a refund.

For the avoidance of doubt, all bookings:

a) cancelled;

b) for persons not meeting the 1.2 meter height restriction for a Nimrod Tour; and

c) arriving with a dog (except a Special Assistance Dog)

will NOT be refunded.

We reserve the right if prevented from supplying RVP or the booked Tour for any reason, to cancel the contract and provide you with a refund of the price you have paid. We will attempt to provide as much notice as is possible. Your remedy for any breach of contract by us is restricted to the remedies set out in these T&Cs and excludes all common law and other remedies.

Safety

Your Tour is located at the RVP, this is an outdoor space that is subject to the elements, please be aware of NATURAL HAZARDS and UNEVEN GROUND. The following is a non-exhaustive list of conditions to be aware of when visiting the RVP:

a) Weather Conditions: Slippery surfaces occur during rain or frost.

b) Animal Activity: Animals may burrow or create uneven spots.

c) Vegetation: Tree roots or overgrown grass can contribute to unevenness under foot.

d) Risk of Tripping: The ground in this area is uneven, which may pose a tripping hazard, so be mindful of your steps.

e) Watch Your Footing: Pay attention to where you walk, as uneven surfaces can cause slips, trips, and falls.

Price and Payment

The price is as stated at the time of booking, is in pounds sterling and includes VAT.

Payment must be made in advance and online. Payment may be made using one of the following payment cards;

a) Delta;

b) MasterCard;

c) Solo;

d) Switch;

e) VISA

We reserve the right not to fulfil your booking if;

a) your card is declined for any reason; or

b) if the payment card has been used fraudulently or without the cardholder's permission; or

c) if you are under the age of 18.

All payments must be made before the Tour takes place.

Bookings for Educational and Group Bookings will be held for 14 days, if your deposit and booking form have not been received within 14 days of the initial reservation being made we will assume that you no longer require the Tour, and remove your details from our files. Only once your deposit and booking form have been received, will your booking become confirmed.

Data Protection

It will be necessary for your personal data to be disclosed to the relevant card issuer for the purpose of processing and confirming your payment. Your financial data will not be disclosed to third parties other than the financial institution for the chosen payment method.

We will process the personal data provided by you to us for the purpose of processing your booking and delivering the RVP Tour to you in accordance with the applicable requirements of the Data Protection Legislation and Our Privacy Policy which can be found at Manchester Airport Privacy Notice | Manchester Airport.

Feedback

Although we attempt to provide our customers with a satisfactory service should you have any complaints please use our feedback form.

Exclusion of Liability

We will not be responsible for any costs, compensation costs or expenses relating to any other services that you may have arranged in relation to the Tour. You are responsible for ensuring that you allow sufficient time for car parking and arrival at the Tour. We shall not be liable to you if you miss your Tour because you did not allow sufficient time.

We are unable to guarantee that all advertised elements of the Tour will be available. Due to our operational needs, we may be required (on short or no notice) to

a) replace any parts of the Tour;

b) change the contents of the Tour and/or

c) close parts of the Tour without any liability whatsoever by way of compensation, refund, readmission or otherwise.

We nor any RVP Staff are responsible for any property lost or damaged on a Tour.

Nothing in these T&Cs shall exclude or limit our liability for:

a) death or personal injury caused by us or our employees’ negligence during the course of their employment; or

b) any other conduct for which liability may not be excluded or limited as a matter of English law.

General

Waiver by us of any breach of the T&Cs by you shall not prevent subsequent enforcement by us nor be deemed to be a waiver of any subsequent breach.

Any failure or delay by us in exercising any right or remedy provided under these T&Cs or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict future exercise of that or any other right or remedy. No single or partial exercise of any right or remedy provided under this contract or by law shall prevent or restrict the further exercise of that right or remedy.

In the event that any condition(s) of these T&Cs is/are declared void, ineffective or unenforceable by any competent court, the remainder of the T&Cs shall remain in effect as if such void, ineffective or unenforceable condition(s) had not been included and the parties shall negotiate in good faith to agree a replacement provision that, to the greatest extent possible, achieves the intended commercial result of the original provision.

No third party shall have any rights to rely on or enforce this contract under the Contracts (Rights of Third Parties) Act 1999.

The T&Cs constitute the entire agreement and understanding between the us and you in relation to the Tour booking.

We reserve the right to make amendments to these T&Cs from time to time, provided that the amendments shall not result in you receiving any less than the same or substantially similar benefits to those that you were entitled to receive prior to such amendments. Up to date versions of the T&Cs will be made available as soon as practicable on the Website.

The laws of England and Wales govern this contract and any dispute will be resolved exclusively in the courts of England and Wales.
